			<p>In the current Immigration context, Post-Licence Sponsor compliance visits have become increasingly more common than ever before.  While being granted a Sponsor Licence is a privilege, it is the licensed sponsor’s duty to maintain the sponsor license and protect sponsored workers.</p>
<p>Home Office compliance officers can at any time conduct an announced or unannounced compliance visit on site or virtually. During the compliance visit, the compliance officers will interview the Sponsor Licence holder, sponsored workers, and review the HR system of the company. These compliance visits can be triggered due to many reasons, including if the Home Office receives any intelligence about the organisation.</p>
<p>Any licensed sponsor should comply with their sponsor duties. These duties can be broadly categorised into 5 key areas. Post-licence Compliance visits are centred around these 5 major areas of compliance.</p>
<ol>
<li><strong>Record Keeping</strong>&#8211; As a Licenced Sponsor, do you retain key documents required for the company and each sponsored worker? These documents include Passports, Right to work checks, employment contracts, contact details of migrants, etc.</li>
<li><strong>Reporting</strong>&#8211; If there are any changes to the company or to the terms of employment of any sponsored workers, do you report these changes to the Home Office within the prescribed time limits?</li>
<li><strong>Complying with the Law</strong>&#8211; Do you adhere to the UKVI guidelines and comply with the broader UK legal system including employment laws?</li>
<li><strong>Genuine Vacancy</strong>&#8211; Are you hiring a migrant to fill a genuine vacancy within the company and is the identified migrant the right fit for the vacancy?</li>
<li><strong>Co-operating with the UKVI</strong>&#8211; Do you usually cooperate with the UKVI, for instance by responding to queries, requests for further evidence and assisting them as required?</li>
</ol>
<p><strong>During a Sponsor compliance visit, the compliance officer will primarily assess the following:</strong></p>
<ul>
<li>that a licensed sponsor is meeting their sponsorship obligations</li>
<li>that the sponsor has the necessary HR systems and procedures in place to meet their sponsorship obligations</li>
<li>whether the sponsor is complying with their obligations to prevent illegal working</li>
<li>whether the sponsor or the sponsor’s activities pose a threat to immigration control</li>
<li>whether the original number of CoS requested on the sponsor application or annual request is still justified</li>
<li>whether those working with the sponsor are complying with any conditions of their leave to stay in the UK</li>
<li>whether the sponsor continues to have an operating or trading presence</li>
<li>whether sponsored workers were recruited to fill genuine vacancies which meet the requirements of the relevant immigration route in respect of skill level and pay all aspects of the tasking referral</li>
</ul>
<p>The compliance officers will also check employee files for sponsored workers, right to work documentation, and conduct interviews with sponsored workers.</p>
<p>Any issues flagged up during these compliance visits can have serious consequences on a sponsor licence holder. For instance, the Home Office can revoke, downgrade or even suspend a Sponsor License based on the outcome of a compliance visit. Therefore, it is crucial for any licensed sponsor to be fully prepared for any Home Office compliance visit.</p>

			<p>Hiring a skilled worker for your company is a way to unlock growth and business productivity. However, in the hiring process, the company can lose time, money, and compliance footing, as well as many other things.</p>

<p>When HR, finance and the operations departments collide, it can be very difficult to see a resolution. HR tend to focus on hiring speed, as they need someone to fill a role as soon as possible. Finance focuses on the cost to the company and tries to see the best way the company can benefit. Lastly, the operations handles the day-to-day backend process, such as production and logistics. When all these departments overlap, last-minute firefighting can occur, bringing to light delayed approvals and budget surprises. In order for a cross-functional process to occur, the best way to overcome the surprises is to create a shared process for all sponsored hires, including finance, so that they can sign off early on the total cost, and all departments are kept in the loop.</p>

The sooner you plan, the fewer surprises manage in the future, a crisis averted.</p>
<h3>5. Leaving Sponsorship Too Late in the Hiring Process</h3>

			<p>When we move to a new place, we look at who our neighbours are. We seek like-minded people. Why? That gives us the feeling of being a part of society. Likewise, a society with a large number becomes a community. A relation is a two-way traffic. As we seek comfort from our society, the society as well seeks comfort from us. This comfort can be provided in various ways.</p>
<p>As an immigrant, when we move to a new country, the first thing we look for is a community that is from our home country. We quickly become a part of that community and feel at home away from home. We want to make the migrated country our permanent home in the long run; however, sometimes we hesitate to even adapt to the country’s culture. We want to limit ourselves to only our home country people or culture and unknowingly separate ourselves from the people of the country where we have migrated to.</p>
<p>Of course, we cannot just randomly pick up a conversation with an unknown person at the Town Centre; however, we can always look at places where we can pick up such a conversation and build from there.</p>
<p>For me, it all started when I first arrived here in the UK back in September 2021 from India. A new country, new culture, new people and I felt I was away from my home and comfort zone. I am an introvert, so, no chance I could just make new friends right away. I was still getting used to the cold, depressing weather of London and the early-to-bed life. I came from Mumbai, and I am sure all will understand how much self-adjustment it was.</p>
<p>I wondered how I could fit in this country. I was very conservative about my approach, thinking my thoughts and perceptions might not be accepted, as I am a migrant. I was incorrect there, and my thoughts about community changed when, one Sunday, I just visited our local church. Though on the set, the scenario in the Church of England was completely different from the Catholic Church, which I had visited all my life in India, this place changed my perceptions and my view of a community. I sat in the last pew, looking around the church building and appreciating the architecture and history that ran 100s of years old, when suddenly an elderly couple walking into the church greeted me. They were so genuinely happy to see me, an Asian man, in their church. They introduced themselves to me and started talking about themselves, about the church, and its history. This elderly couple was so eager to introduce me to the other church members and were so excited to see me, as I was one of their family members. Time went by, and I never realised that by the end of the service, I was smiling and talking to people whom I did not even know a couple of hours ago. This small incident changed my life completely here in the UK.</p>
<p>I started going to the church regularly. I worked throughout the week and always looked forward towards the Sunday morning service, wherein I could meet my new church family, share my week and get to know about theirs. With time, I got to know each of the church members by name and started to actively participate in the small activities, which could reach out to many people in society in general. These activities opened opportunities for me to know the people of the United Kingdom and Great Britain far better. I felt not only comforted at home away from my home, but I also felt peace and tranquillity when I could make the people around me in the community smile with a small participation in any activity or even just a general smile and a greeting. I couldn’t realise how much time would have passed by since September 2021, my first visit to the church till today. Willingly being a part of the community and serving has rewarded me with becoming a valued member of the Parochial Church Council and representing my church as a member of the Deanery Synod. By serving the community here in London, in the Borough of Harrow, for a little over 4.5 years now, I feel extremely proud to be an Equality, Diversity, and Inclusion Officer for our local church, and I feel more responsible towards my community, which I would not have felt if I were in my home country.</p>
<p>I feel we as human beings should always look to be a part of the larger community, wherein we can serve them to feel the inner joy and peace, rather than just receiving it from the community through social gatherings and events. This makes one feel more responsible as a person, as a citizen, and most importantly as a human being.</p>

			<p>In Autumn the roll out to <strong>&#8216;Earned Settlement&#8217; </strong>will be announced, at present most people qualify for Indefinite Leave to Remain after 5-continuous years of lawful residence in the UK, though the Autumn announcement will see a shift in this, where the baseline qualifying period will be increased to 10-years, in some cases the qualifying period will go up to 20-years in the following instances:</p>
<ul>
<li><strong>15-years</strong>&#8211; Skilled Workers who have been assigned a CoS under a medium Skilled Occupation Code (RQF level 3-5)</li>
<li><strong>20-years </strong>&#8211; Refugees granted asylum</li>
</ul>
<p>The factors which will affect the qualifying period increasing or decreasing will be as follows:</p>
<ul>
<li><strong>English Language Requirements</strong></li>
<li><strong>Income</strong></li>
<li><strong>Public Funds</strong></li>
<li><strong>Suitability requirements</strong>&#8211; inc criminal history</li>
<li><strong><strong>Immigration History</strong></strong></li>
</ul>
<p>The above factors (subject to consultation) could result in the qualifying period being shortened or increased as follow.</p>
<p><strong>Reduce the baseline qualifying period </strong>&#8211; only one of the listed considerations (i.e. the one that causes the largest reduction) would be applied in the case of any single application, and additional years will take precedence over any reduction to the baseline.</p>
